Cellforcash.com User Agreement

Introduction
Cellforcash.com provides an online vehicle for consumers to sell their unused wireless handset(s). The online quote generator provides a firm quote in real time for qualified users. We reserve the right to amend, cancel or alter these services at our sole discretion.

THE USE OF THIS SITE IS GOVERNED BY THE POLICIES, TERMS AND CONDITIONS SET FORTH BELOW IN THIS USER AGREEMENT ("AGREEMENT"). PLEASE READ THIS AGREEMENT CAREFULLY. YOUR REGISTRATION, YOUR USE OF THIS SITE AND YOUR PLACEMENT OF A TRANSACTION AND/OR AN ORDER INDICATES YOUR ACCEPTANCE OF THESE POLICIES, TERMS AND CONDITIONS.

WE MAY AMEND THIS AGREEMENT AT ANY TIME BY POSTING THE AMENDED TERMS ON OUR SITE. EXCEPT AS STATED BELOW, THE AMENDED TERMS WILL AUTOMATICALLY BE EFFECTIVE IMMEDIATELY AFTER THEY ARE POSTED.

Registration
Our services are available only to registered users who can form legally binding contracts under applicable law. Our services are not available to minors. If you do not qualify, please do not attempt to use our services. Registration requires the completion of the user registration form with accurate and complete contact names, principal address, and e-mail address.

Your use of Cellforcash.com may be terminated or suspended by us if you do not comply with this Agreement, our policies and procedures, or for any other reason we determine necessary, in our sole discretion, to protect us and other users of the site.

Transaction Acceptance Policy
Your receipt of a transaction confirmation only signifies that Cellforcash.com will pay full value if the handset(s) sent are in acceptable condition as outlined below.

The shipment of your handset(s) confirms your acceptance of our price and condition offer. Under no circumstances will handset(s) be returned unless our offer is different that originally agreed to.

Your receipt of a trade confirmation only signifies that CellForCash.com will pay full value if the handsets sent are in acceptable condition as outlined below. No trade over 1000 handsets/pagers or $10,000 will be accepted online.

Shipping
CellForCash.com provides United States Postal Service flat rate boxes and a pre-paid mailing for return shipping. CellForCash.com will not be liable for any damages or loss of shipment during transit. It is the responsibility of the user to insure or provide for delivery confirmation prior to shipping.

Condition of Handset(s)
In order to qualify for payment all handset(s) must be in working condition. They will power-up and make a test call. They will not be crushed, water damaged or have broken LCD's. Housings should be complete and unbroken. All handset(s) shall have a valid ESN.

Any handset(s) sent in other than those listed on the initial transaction will not be returned and will become the property of Cellforcash.com.  These units will be recycled. Please verify the accuracy of your transaction before submitting for approval. If you wish to change your transaction simply contact Customer Service online. Please include battery, battery door (if applicable) and charger.

In the rare event that an exception is made and a phone is sent back per the user’s request, Cellforcash.com will make every effort to send the original phone, but can only guarantee that you will receive the same model, not the exact handset(s) that was sent in.  If the unit was working, you will receive back a working unit.  If the unit was defective you will receive back a non-working unit.

Cell Phone Service
It is the responsibility of the user to discontinue service on handsets sold to Cellforcash.com before initiating a transaction. Cellforcash.com is not responsible for previous or subsequent airtime charges accrued prior, during, or after any transaction. Should any airtime charges be accrued, it is the responsibility of the original user and service provider to resolve payment issues.

Cell for Cash Policy Concerning Pornography, Child Pornography, Evidence of Illegal Activity
Cell for Cash will report to the proper authorities and if required, surrender to the proper authorities any device including but not limited to a cellular handset, IPod or computer storage device that CFC receives, that has stored on it illegal data, including but not limited to illegal pornography, child pornography and any evidence of illegal activity.

Lost or Stolen ESN
It is the user's responsibility to ensure Cellforcash.com does not receive phones with ESN numbers reported lost or stolen. Should Cellforcash.com receive phones that by the service provider are reported lost or stolen the phones in question will not be returned to the customer and the transaction will become null and void.

Personal/User/Subscriber Information
If desired, it is the responsibility of the user to remove any and all personal information from all phone memory and removable memory including but not limited to, phonebook entries, personal codes, e-mail addresses, personal addresses, IM addresses, photos, and downloaded files. Any personal information including but not limited to the aforementioned data could be used in a negative manner and it is the sole responsibility of the user to clear all information that could be harmful to the user if made public.

Payment
Payment will be made within 45 days of the verification of the handset(s). If there is a dispute in condition users will be notified by e-mail with an adjusted trade offer. If the adjusted offer is not acceptable, Cellforcash.com will return the shipment at the users expense via a minimum $10 shipping and handling charge. If the adjusted offer is accepted the adjusted payment will be made based on the date of the original trade. Cellforcash.com will not be responsible for user delays. User must respond to any adjusted trade offer within two business days or Cellforcash.com will assume the adjusted offer is acceptable and process the shipment using the adjusted offer.

All checks will be issued in "care of" and must be endorsed by the consumer who placed the transaction. Inclusion of "Company Name" on transactions does not imply that checks will be issued in care of that company. Should a change need to be made, a $25 fee will be deducted from the adjusted check.

Pricing
All pricing is subject to change without notice. For all prices, products and offers, Cellforcash.com reserves the right to make adjustments due to changing market conditions, product availability, and other extenuating circumstances.

Quick Ship Option
Handsets that are shipped using the quick ship option are subject to the pricing and accepted model list that is in effect at the time they are received not the time that they are shipped. User agrees that CellForCash.com's offer to purchase is final and binding. Prices and accepted models are subject to change without notice at the sole discretion of CellForCash.com. If a user submits a handset that is not listed they shall receive no payment. Handsets shipped using QuickShip will not be returned to user.

Referral Program

CellForCash.com will pay users $5 for each completed transaction referred by that user. A completed transaction is one that CellForCash.com has paid the original agreed upon price and value. All referral transactions are governed by the terms and conditions of this user agreement.

A user only qualifies for a referral commission if they have completed their original transaction. A valid transaction completed before the referring transaction does not qualify for a referral commission payment.

Several transactions from a single user over a 24 hour period of time will be treated as one transaction. In this event the referring user would only qualify for one referral commission. CellForCash.com may disqualify any referral commission, at its sole discretion, if attempts have been made to circumvent or manipulate the intended operation of this program.

Expiration of Offer
All trade offers will expire 45 days from the date of trade confirmation. All confirmed trade pricing will be honored within the 45 day period regardless of current pricing.

Use of Cookies
Cookies are small pieces of information that are stored by your browser on your computer's hard drive. Cellforcash.com uses cookies to personalize your trading experience.

Most web browsers are automatically set to accept cookies. To change this, or to show a warning each time a cookie request is received, please review your browser's guidelines. USE OF COOKIES IS REQUIRED TO UTILIZE Cellforcash.com. Trade-in Cookies expire automatically.

Suspension and Termination
We may issue a warning or temporarily suspend, indefinitely suspend or terminate your membership or any of your trades or purchases if (i) you breach this Agreement, (ii) your provide us with false information or we are unable to verify or authenticate any information you provide to us, (iii) you infringe the intellectual property rights of others or (iv) you engage in any act of collusion or price manipulation.

Legal Compliance
You agree to comply with all applicable laws, statutes, ordinances and regulations regarding your use of our service and your bidding on and purchase of items.

Independent Contractor
This Agreement and your membership in no way constitute or give rise to a partnership, joint venture or other relationship between the parties. Each of us will operate under the terms of this Agreement as an independent contractor and not as an agent for the other.
